1. Agreement to these terms

These Terms of Use govern your access to and use of newjerseysidewalkshed.com (the “Site”), operated by Mian Legal Entity, trading as New Jersey Sidewalk Shed & Scaffolding (“we”, “us”, “our”). By using the Site you agree to these terms. If you do not agree, do not use the site.

These terms govern use of the Site only. They do not govern the supply of any services. Where we are engaged to survey, file, supply, install, maintain, inspect or remove any structure or equipment, that work is governed by the written contract for that engagement. If anything here conflicts with that contract, the contract prevails.

You may use the Site for lawful purposes and to learn about our services. You may not:

Use the Site in any way that breaches applicable law
Attempt to gain unauthorised access to the Site, its servers, or any connected system
Introduce malware or anything designed to disrupt the Site
Scrape, harvest or systematically extract content except as permitted by our robots file
Reproduce, republish or redistribute Site content for commercial purposes without our written permission
Submit false, misleading or fraudulent information through any form

4. Intellectual property

The Site and its content (text, layout, graphics, photographs and design) are owned by us or our licensors and protected by intellectual property law. You may view and print pages for your own reference or for evaluating our services. All other rights are reserved. Where we quote or summarise building codes, regulations or public agency material, those sources remain the property of their publishers and are used for informational purposes.

5. Enquiries are not contracts

Submitting an enquiry, requesting a survey or asking for a quotation does not create a contract and does not oblige us to accept the work. A contract arises only when we issue a written quotation for a defined scope and you accept it in writing, subject to our contract terms. Any figure or range mentioned on the Site is illustrative. Pricing follows a site survey.

6. Information on the Site

The Site includes summaries of building codes, permit requirements, training obligations and safety standards. That material is general information, not advice, and requirements change. It does not take account of your building or project. See our Disclaimer. We do not guarantee any regulatory outcome, including the approval of any permit, the timing of any application, the result of any inspection, or the dismissal of any violation.

7. Availability

We aim to keep the Site available but do not guarantee uninterrupted access. We may suspend, withdraw or change any part of the Site without notice.

8. Third-party links

The Site links to third-party websites, including government and regulatory sources. We do not control them, do not endorse their content, and accept no responsibility for them. Following an external link is at your own risk.

9. Disclaimer of warranties

The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy or currency of content.

You agree to indemnify and hold us harmless against any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of the Site.

13. Changes to these terms

We may revise these terms at any time. The current version is posted here with the date it was last updated. Continued use of the Site after a change constitutes acceptance.

14. Severability and waiver

If any provision is held unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it.

15. Governing law and venue

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. You agree that the state and federal courts located in Essex County, New Jersey have exclusive jurisdiction over any dispute arising from these terms or your use of the Site.
